									<p>Government ministers have decided Kent and Medway will be served by four councils from April 2028, in the biggest shake up of local authority arrangements in 50 years.</p><p>The government is replacing Kent County Council, Medway Council and the 12 district, borough and city councils that currently deliver services in the county with four new unitary councils. </p><p>Those councils will deliver all the services in their area, much like Medway Council does today, including education, social services, highways,  libraries,  emptying bins, leisure centres and housing services. </p><p>Following a government consultation which attracted around 3,000 responses, the Secretary of State has opted for 4b: </p><ul><li>a unitary council covering the areas currently served by  Sevenoaks, Tonbridge and Malling,  Maidstone and Tunbridge Wells in the west.</li><li>A unitary council covering Dartford, Gravesham and Medway in the north.</li><li>A unitary council covering Swale, Ashford and Folkestone and Hythe in the centre of Kent.</li><li>A unitary council covering Canterbury, Thanet and Dover in the east.</li></ul><p>Leader of Tonbridge and Malling Borough Council, Matt Boughton says:</p><p><em>“We welcome ministers’ decision to move forward with a four unitary council model for Kent and Medway. Throughout this process, Tonbridge and Malling Borough Council has consistently supported an approach based on strong independent evidence that offers the best balance of high-quality, cost-effective services and alignment with local communities. We will now continue to work constructively with partners to ensure a smooth transition and the best possible outcomes for our residents.”</em></p><p>In a statement, Kent and Medway’s council leaders said: <em>“We want to reassure our residents that not one of our services will change overnight – you will still be dealing with the same council staff tomorrow and the day after that. The new councils will come into effect from 1 April 2028. </em></p><p><em>“All of the councils in Kent and Medway have a long history of working closely together to do the very best for the people we serve and that will not change one bit. </em></p><p><em>“This is the start of the process of bringing our different teams together with the aim of designing then delivering the best possible services for the people we serve. Of course, this change affects the thousands of council staff across the county who work incredibly hard day in and day out. Our focus will be supporting them through this change while helping them to carry on delivering our business-as-usual services seamlessly. </em></p><p><em>“There is a lot of work to do but we will make sure we take every opportunity to make our services the very best they can be.” </em></p><p>Read the background to local government reorganisation:-<a href="https://kentcouncilleaders.org.uk/" target="_blank" rel="noopener"><strong>https://kentcouncilleaders.org.uk/</strong></a></p>								</div>

									<p><strong>Residents of Tonbridge are being consulted about plans for a new town council.</strong></p><p>Currently Tonbridge is the only area of the borough without a town or parish council but that could change.<u></u><u></u></p><p>Leaflets will be posted to homes in Tonbridge outlining what’s happening and what it would mean for residents. If the proposal is approved, the new body could take responsibility for some local services, which are currently managed by the borough council.<u></u><u></u></p><p>The consultation runs until Monday 14 July.</p>								</div>

									<h3>Development Site North of Hadlow Park,  Maidstone Road, Hadlow, Tonbridge, Kent</h3><p><strong><a href="https://publicaccess2.tmbc.gov.uk/online-applications/PLAN/22/02640/OA">https://publicaccess2.tmbc.gov.uk/online-applications/PLAN/22/02640/OA</a></strong></p><p><strong>TM/22/02640/OA</strong> &#8211; Outline planning application (with all matters reserved except for access) for the development of 101 dwellings (Use Class C3) with play space, drainage infrastructure and attenuation areas, parking and associated infrastructure, associated access from Maidstone Road together with pedestrian and cycle links, and landscaping.</p><h3>Hadlow Parish Council objects to this planning application on the following grounds:</h3><ul><li>The site sits within the Green Belt and the Applicant has not demonstrated that ‘very special circumstances’ exist which would justify the removal of Green Belt designation and subsequent development for residential use. TMBC’s current inability to demonstrate an adequate 5-year housing supply is not, in itself, sufficient to override GB policy under the NPPF. Major development should be focused on brownfield sites within the Borough.</li><li>Due to the known history of flood issues on and around this site, we are not satisfied that this has been properly or adequately addressed by the Applicant in their outline design. Any substantial development of the site as proposed is likely to cause flooding problems to neighbouring properties and the A26.</li><li>There is likely to be an adverse impact on the public footpath adjoining the southern boundary of the site in terms of loss of amenity and light pollution.</li><li>Whilst the access onto the A26 may be acceptable for a vastly reduced scheme, a development of this scale and size would generate large numbers of vehicle movements, particularly at peak times, placing additional stress on the local road system, especially the A26 through the centre of Hadlow, and adversely affecting air quality. The High Street is a Conservation Area where traffic flow and parking is already a significant problem at peak times.</li><li>Due to the proximity of the access to other junctions and driveways joining the A26, there is an increased risk of road traffic accidents.</li><li>A development of this size would also place an intolerable additional burden on the local infrastructure and services in Hadlow, specifically the medical centre, dentist, schools etc, and the location of some of these facilities does not allow expansion. Therefore, the financial contributions suggested by various Consultees are very unlikely to enable these issues to be resolved in the foreseeable future.</li><li>This scheme would inevitably place heavy reliance on local bus services into Tonbridge, Maidstone and Tunbridge Wells schools. These services are already at, or close to, capacity at peak times, where the current trend is for a reduction in the frequency of services.</li></ul>								</div>

									<p>People who drop litter in Tonbridge and Malling will face fines of up to £150 as part of a borough-wide drive to reduce rubbish on the streets of towns and villages.</p><p>Tonbridge and Malling Borough Council is launching a 12-month pilot scheme with leading enforcement company, NES, to clamp down on the dropping of food wrappers, cigarette butts, bottles, cans and other waste.</p><p>Specialist officers from NES will be out and about across the borough targeting litter and fly tipping hot spots using body-worn cameras to capture evidence. They will also undertake a range of initiatives, including handing out portable ashtrays and dog poop bags. Support for school education projects and sponsored litter picks will also be provided.</p><p>The enforcement teams will be able to issue on-the-spot fixed penalties to anyone seen dropping litter, failing to clear up after their dogs, dumping rubbish or committing other offences, such as transporting waste without a licence. Penalties are as follows:</p><ul><li>Littering: £150 reducing to £100 if paid within 10 days</li><li>Dog fouling: £80 reducing to £50 if paid within 10 days</li><li>Fly tipping: £400</li><li>Other waste offences: £300</li></ul><p>The council currently has approximately 1,150 public litter bins across the borough and more than 600 dog waste bins. The 2022/23 budget for street cleaning, emptying litter bins and clearing fly tips is £823,000.</p><p>The pilot scheme is being delivered at zero additional cost to the borough. NES will receive income from any fixed penalty notices that are issued. It will also free up council resources to focus on day-to-day waste collection services and to support wider enforcement and investigation. The project will start in October 2022 and be reviewed after 12 months to assess its effectiveness in reducing littering.</p><p>Cllr Piers Montague, lead cabinet member for waste and technical services, said: ‘We are lucky to live in a beautiful borough but all too often the actions of a few selfish people blight our towns, villages and roadside verges. The message to those who think it’s ok to discard cigarette butts, food wrappers or other rubbish on the streets is simple: please use the bins provided or take your rubbish home. If you litter our streets, expect to face a penalty.</p><p>‘While NES has a strong track record in targeting those who drop litter, this is not just about enforcement. The teams will also deliver a range of activities which help educate and inform people about the impact of litter and dumped rubbish which can contribute to anti-social behaviour and harm wildlife.’</p><p>Eoin Henney, Director of NES, said: ‘National Enforcement Solutions is excited to be selected by Tonbridge and Malling Borough Council to tackle these types of environmental crimes. With educational campaigns and our positive enforcement strategy we can support the local authority to achieve its goals and objectives across the borough.</p><p>‘We will be working closely with the council’s own internal team to gather intelligence around the crimes that blight the streets. We will not only be focusing on observational offences but using information reported to investigate larger environmental crimes.</p><p>‘Our officers are trained in-house and our training is externally endorsed. The public and the council can rest assured that our teams can make a difference.’</p>								</div>

									<h3>Response to TMBC from Hadlow Parish Council:</h3><p>Hadlow Parish Council (HPC) objects to the above planning application on the grounds that the site is within the Green Belt and comprises Grade 1 agricultural land which is in short supply. As such the NPPF prohibits development unless ‘very special circumstances’ can be demonstrated by the Applicant and HPC does not believe that the Applicant has achieved this.</p><p>In addition, HPC would bring a number of concerns to the attention of TMBC, which we believe are relevant in determining this application:</p><p><strong>Highways:</strong></p><ul><li>Court Lane is a relatively narrow road which is unsuitable for HGV’s and is effectively single carriageway for most of its length from the A26 up to the site entrance due to on-street parking. Vehicles frequently have to drive on the pavement to pass through, including those of TMBC’s refuse Contractor and emergency vehicles.</li><li>The access into and egress out of Court Lane from/onto the A26 is extremely difficult at present, there having been a number of accidents in recent years, and with vehicles, particularly larger vans and HGV’s, having to mount the kerb. This part of Court Lane is within the village Conservation Area and buildings already suffer damage from accidents and vibration from heavy traffic.</li><li>The traffic survey undertaken by the Applicant is not relevant or representative, in our view, as this was carried out during a school holiday period and during Lockdown, when traffic flows were clearly reduced significantly.</li><li>A development of this scale is likely to result in many more pedestrians, particularly children, having to use Court Lane, with a clear risk to their safety. The existing pavements are narrow in places making it extremely difficult for parents/carers with buggies.<br /><br /></li></ul><p><strong> Infrastructure:</strong></p><ul><li>The medical centre and the dentist in Hadlow are already fully subscribed and cannot cope with the additional demand which the new Carpenters Lane development will generate. This would be further compromised by the proposed development in Court Lane.</li><li>A £51,696 contribution from the developer, as stipulated by the NHS Strategic Planning &amp; Estates Team in their response, is purely formulaic and in itself guarantees nothing in terms of additional services.</li><li>HPC does not believe that either the medical centre or the dentist in Hadlow are capable of being expanded in terms of their physical building constraints, without relocating and/or requiring substantially higher capital investment.<br /><br /></li></ul><p><strong>Biodiversity:</strong></p><ul><li>The Applicant’s report was written after numerous trees on the site had been removed, with reference made to the historic position having been ‘factored in’. HPC does not believe that this is a true or fair representation of the wildlife or biodiversity of the site and is concerned that no proper provision has been made as a result.</li><li>The proposed development will impact adversely on green space in Hadlow. Such areas must be preserved as their benefit to both physical and mental health is well recognised.<br /><br /></li></ul><p><strong>Scheme Design:</strong></p><ul><li>HPC is concerned about the 21⁄2 and 3 storey elements of the scheme design, as these are not typical in Hadlow. In particular, the 21⁄2 storeys proposed adjoining the Access Trail, The Forstal and Nursery Close are inappropriate and are likely to create overlooking with consequential loss of amenity and possibly infringing rights of light.</li><li>HPC is also concerned that the Applicant has not fully taken into account the flood risks on the site and/or to neighbouring properties from surface water run-off, as we understand that the site was originally designated as the flood run-off when The Forstal was built.</li><li>Car parking provision within the scheme may correspond to KCC minimum standards but is still unlikely to cope with the actual demand from on-site residents and their visitors. This is likely to cause overspill parking to occur in neighbouring roads (i.e. Court Lane, The Forstal and Appletons) which are already very congested. The large majority of residents in The Forstal are elderly and many are disabled to a greater or lesser extent.</li><li>We also understand that the existing Saplings Nursery experiences significantly more demand for car parking than stated by the Applicant. As a result, the car parking provision proposed for the new Nursery building appears to be significantly under-estimated, which is likely to create overspill parking to occur both within the site and also in the surrounding roads. The proposed Nursery is also likely to create light pollution to neighbouring residents.</li><li>The Affordable Housing elements are to be welcomed in any proposed scheme, although HPC is concerned at how affordable these properties will be for local residents and workers and whether the ‘affordability’ will be maintained beyond the first sale.</li><li>The Applicant has placed great weight on the use of footpath past the Churchyard as the principal pedestrian route from the site into the village centre. HPC is concerned at the safety of this route at night as it is mainly unlit.</li><li>Evidence of sustainability is, at best, minimal. HPC believes the above objections clearly show that the Applicant has not demonstrated ‘very special circumstances’ why this proposed development should be approved. If, however, TMBC is minded to grant consent in whole or in part for residential development on the site, HPC believes that the following Conditions or Restrictions should be imposed. In no particular order these are:</li><li>Traffic calming measures should be introduced in Court Lane to reduce the speed of vehicles. This should certainly include relocating the existing 60mph speed limit to the east and might also include the introduction of speed humps between the site entrance and the A26 and a chicane (possibly with Hadlow Village gates) to the east of the site entrance.</li><li>Ways in which Court Lane can be widened should be investigated, possibly including converting the northern pavement to roadway, although we fully accept that this would be controversial and problematic for the residents directly affected.</li><li>It would also be advisable to improve the safety of the junction of Court Lane with The Forstal by introducing double yellow lines in Court Lane either side of The Forstal for a short distance.</li><li>Overspill parking from residents of the site and their visitors into Court Lane, The Forstal and Appletons must be avoided, for the safety of existing residents and to avoid nuisance. This should be fully investigated and might be achieved by way of highly localised restricted parking and/or permits, although the practicalities, affordability and enforceability of such a scheme are unclear.</li><li>TMBC should satisfy itself independently regarding the traffic implications of any scheme and, if appropriate, seek a new traffic survey to be undertaken at peak/normal traffic flow times.</li><li>TMBC should also satisfy itself independently that the flood risks from surface water run-off for the site and neighbouring properties are within acceptable limits.</li><li>A Construction Traffic Management Plan should be agreed and enforced to ensure that HGV movements during the development are carefully controlled and, in particular, that left turns from the A26 into Court Lane and the use of alternative routes (e.g. Cemetery Lane and via Golden Green) are prohibited.</li><li>The car parking demand for the proposed new Nursery should be re-examined and, if necessary, the capacity of the Nursery reduced accordingly.</li><li>HPC would like to see a scheme put in place to preserve and guarantee the discounted Affordable Housing element in perpetuity and to ensure that local residents and workers (i.e. from Hadlow) have first refusal wherever possible.</li><li>All existing mature trees and shrubs etc along the boundaries of the site should be retained, in order to maintain maximum screening for neighbouring properties particularly in The Forstal, Court Lane and Nursery Close. Replacement trees will take many years to reach maturity.</li><li>Lighting of the pedestrian footpath along the Churchyard should be improved.</li><li>If the 21⁄2 and/or 3 storeys elements of the scheme are to remain, adequate screening from exiting neighbouring properties should be imposed, including the use of restricted openings and opaque glazing of windows to prevent over-looking and loss of amenity.</li><li>All permitted development rights for the scheme should be removed including a restriction on the future conversion of garages and car ports to habitable accommodation – in order to retain as much formal parking on the site as possible.</li><li>Some of the above concerns would be ameliorated if the scheme were to be reduced significantly in size.</li></ul>								</div>

									<p>Tonbridge and Malling’s new Local Plan will shape our community until 2040. As they start developing this Plan, they are asking for your thoughts on how you would like it to be approached. The Local Plan is key as it identifies how they can provide affordable homes, safeguard green spaces and deliver local jobs in Tonbridge &amp; Malling towns and villages.</p><p>The requirement from Government is to plan for 15,941 new homes within the boundaries of Tonbridge and Malling during this time. No sites have yet been committed in developing the new Local Plan. First, they are asking you – through this consultation – for your thoughts on the principles that should determine where these homes should be built, and how they can deliver much needed infrastructure improvements across Tonbridge and Malling. Meeting this need will be difficult given how much of our beautiful landscape is protected, and the constraints on growth in many communities. They  will continue making the case to the Government that the need in Tonbridge and Malling should be reduced.</p><p>In the meantime, a Local Plan must be adopted as soon as possible so that the borough is not  vulnerable to inappropriate development that places an unsustainable burden on our infrastructure.  There are many issues to tackle, and different options on how to do so. TMBC&#8217;s documents are designed to seek your views on the best way to meet these challenges and there are various questions they would welcome your thoughts on.</p>								</div>
